Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental enquiries in Barston? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Why do we need environmental searches in Barston? Statutory laws have resulted in a clear-up scheme for polluted areas. The basic position is that the polluter should remediate however where that party disappears (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Barston you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

What is a water authority search ? A water authority search confirms to a new purchaser that the site they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Barston which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

There is more often than not a mortgage to organise and it should be noted that a lawyer cannot rely on a informal confirmation by mortgage broker or anyone else. The conveyancing solicitor should have sight of your official written mortgage offer in order that she may (i) be sure that you are getting the amount you need and be able to check that you can comply with any conditions of the mortgage offer imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills necessary to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barston some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Barston

Are you on the panel of TSB Bank? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Barston? Is this a problem? No because like all modern law firms we rely on technology to assist us in our practice to ensure that matters are dealt with rapidly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barston).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We have obtained Letters of Administration for our family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our costs remain the same as quoted for this type of Seller.

About Barston.

Barston is a village and civil parish in Metropolitan Borough of Solihull in the West Midlands of England. It is approximately 4 miles (6.5 km) east of Solihull and is located inside a large meander of the River Blythe, at the western edge of the Meriden Gap, and midway between the far larger villages of Balsall Common and Hampton-in-Arden. The nearest large city is Birmingham, 11 miles (18 km) away to the west. According to the 2001 UK Census, the parish had a population of 499, increasing to 533 at the 2011 Census.

The village has many historic buildings, some of which are timber-framed. The Church of St. Swithin is a Church of England church which dates from 1721, and is built on the site of an earlier church. The village also possesses two pubs, The Bulls Head and The Malt Shovel, and about 50 residential properties. The Barston Memorial Institute, opposite the Bulls Head, hosts many village activities with a Friday night youth club and regular Art Classes as well as the Barston WI and U3A meetings. There is no bus service or any other form of public transport in the village, although an abandoned bus stop still exists at the end of the central road of Barston, Oak Lane, which is left over from an old-school service from the 1970s and 1980s. Next to the bus stop is an old-fashioned red phone box.

The footballer Robbie Keane owned a house in Barston from 1999 to 2000, whilst playing for Coventry City F.C..
