General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all expenses necessary to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barthomley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Barthomley.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no SDLT. If you are paying between £300,000 and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation often it is around £2500 but is can be more in extreme cases. Second, the lease often contains a mechanism for the assigning to pay a payment to the freeholder based on a % of the market value which is mainly 2% although other formula may be used. The lease will need to be checked carefully.
