General Conveyancing Tips

There is commonly a mortgage to apply for and it should be noted that a lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. We must generally have sight of your formal written mortgage offer in order that they may (i) ensure that you are getting the amount you need and ensure that you can comply with any lender’s conditions imposed in the mortgage offer.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a client makes is not checking the plan properly. It is a good idea to go to the property to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often clients mistakenly think that a piece of land at the side or rear of the house is theirs, only to discover that the legal title to the house doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all expenses necessary to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barton in Fabis some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Barton in Fabis

Are you on the panel of Tesco Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Barton in Fabis.

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between £300,000 and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional costs can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is around £200 but is can be higher in unusual cases. Second, the lease may contains a clause for the assigning to pay a fee to the freeholder based on a percentage of the sale price which is often 1% although other formula may be used. The lease will need to be checked carefully.

About Barton in Fabis.

Barton in Fabis is a village and civil parish in the Rushcliffe district of Nottinghamshire. It has a population of about 250, being measured at 266 in the 2011 Census. The village is just south of Nottingham, being on the other side of the River Trent from Attenborough.

A ferry, Barton Ferry, used to cross the River Trent to the Attenborough side near to the mouth of the River Erewash. A ferry has crossed the River Trent at this point since before 1774.

The name originates from an older name, “Barton in the Beans” (Fabis being Latin for ‘bean’, in the ablative plural), apparently referring to the beans grown in the village. This name was also used for a Leicestershire village, Barton in the Beans, which has retained its name.
