Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental enquiries in Barton le Street? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that I get an Environmental enquiry on the property that we are buying in Barton le Street? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of suppliers including Groundsure. The environmental check results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the property, based upon the information revealed by the search, could be classified contaminated land by the London Borough/council.

What is a Drainage & Water Enquiry ? A drainage search confirms to a future owner that the property they are purchasing is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Barton le Street which are countryside as there may be a a private drainage system.

General Conveyancing Tips

Remember there are commonly one or more related sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all expenses incurred to uphold the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barton le Street some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Barton le Street

Are you able to deal with a mortgage with HSBC Bank plc in Barton le Street? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Barton le Street? Is this a problem? No because like all modern practices we count on technology to assist us in our practice to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barton le Street).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Barton le Street? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We have obtained Letters of Administration for my fathers estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
