Searches on my Conveyancing Quote

What is included in a local authority search covering Barway? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that both of us ask for an Environmental check on the property that we are buying in Barway? Yes we including this in our quote. We would always recommend an environmental check on the land you intend to purchase which is available from a number of search companies including Homecheck. The environmental search results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the land parcel, based upon the information revealed by the search, is likely to be designated contaminated land by the Local Authority.

Apart from showing that the land in Barway is connected to the mains water supply and mains drainage what other information does a a CON29 DW search show? A a CON29DW verifies to a potential owner that the land parcel they are acquiring does not need a “build over consent” because the seller has constructed an addition to the house within three metres of a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a purchaser makes is not checking the plan properly. It is a best to visit the site to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often buyers mistakenly think that a piece of land at the side or rear of the home is theirs, only to later discover that the legal title to the land doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills necessary to upkeep the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Barway some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Barway

Are you able to oversee a mortgage with Cynergy Bank in Barway? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Barway? Is this a issue? No because like all modern law firms we depend on technology to assist us in our work to ensure that matters are dealt with rapidly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Barway).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 36 months.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional expenses can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing replies often in a form called LPE1. The charge for this varies from company to company on average it is around £200-300 but is can be more in rare cases. Second, the lease could contains a provision for the assigning to pay a charge to the landlord based on a percentage of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.
