Searches on my Conveyancing Quote

What is a Local Authority Search and why is it needed in Batcombe? Whilst this is to a conveyancing lawyers and mortgage lenders an crucial part of the home buying process to purchasers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In rare cases the results can be used to alter your offer or and may even make you withdraw from the transaction.

I am told that the local authority Enquiries in Batcombe will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of locating polluted ground and recording these land on registers – this is a process which will take a an uncertain amount of time to accomplish. Needless to say any land parcels entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Why is a drainage search indispensable if you want to extent or alter the land in Batcombe? One of the salient results shows information of any public sewer close to the house you are interested in. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the build more costly.

General Conveyancing Tips

There is more often than not a mortgage offer to organise and it should be noted that a conveyancing lawyer cannot rely on a quick email by mortgage broker or anyone else. He should have sight of your final written mortgage offer in order that he may (i) ensure that you are getting the amount you need and ensure that you can comply with any special conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all expenses incurred to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Batcombe some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Batcombe

Are you able to manage a mortgage with West Bromwich Building Society in Batcombe? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Batcombe? Is this a concern? No because like all modern law firms we depend on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Batcombe).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between £300k and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We are administrators of my fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
