Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental investigations in Battle? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we get an Environmental search on the property mentioned on the conveyancing quote for the property in Battle what will it reveal? The search provides results of present and past contamination risks together with a report from an environmental expert confirming whether or not the land parcel might be classified contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

What is a drainage search ? A drainage search confirms to a new interested party that the land they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Battle which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your house to take about 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills needed to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Battle some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Battle

Are you on the panel of NatWest? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Help to Buy ISAs in Battle? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain actions to ensure release of those funds including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold what additional fees can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by landlords and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation on average it is around £300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.

About Battle.

A battle is a combat in warfare between two or more armed forces. A war usually consists of multiple battles. In general, a battle is a military engagement that is well defined in duration, area, and force commitment. An engagement with only limited commitment between the forces and without decisive results is sometimes called a skirmish.

Wars and military campaigns are guided by strategy, whereas battles take place on a level of planning and execution known as operational mobility. German strategist Carl von Clausewitz stated that “the employment of battles … to achieve the object of war” was the essence of strategy.
