Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the land you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your borough council covering Battlefield. Usually, you can search most planning applications on line by postcode or by map search).

Do you recommend that I ask for a Environmental search on the property that we are buying in Battlefield? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search providers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the area, based upon the information revealed by the search, might be classified contaminated land by the council.

Apart from showing that the land parcel in Battlefield is connected to the mains water supply and mains drainage what other results does a water authority search contain? A a CON29 DW search illustrates to a new purchaser that the land parcel they are buying does not need a “build over consent” because the seller has constructed an alteration within three metres of a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all expenses needed to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Battlefield some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Battlefield

Are you on the panel of Precise Mortgages? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Battlefield? Is this a problem? No because like all modern practices we depend on technology to assist us in our firm to ensure that matters are dealt with promptly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Battlefield).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold what additional payments can we anticipate? We cannot give you all the expenses up front in our quote. The costs charged by freeholder and managing agents will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation often it is around £200-300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two maisonettes.

About Battlefield.

A battlefield, battleground, or field of battle is the location of a present or historic battle involving ground warfare. It is commonly understood to be limited to the point of contact between opposing forces, though battles may involve troops covering broad geographic areas. Although the term implies that battles are typically fought in a field – an open stretch of level ground – it applies to any type of terrain on which a battle is fought. The term can also have legal significance, and battlefields have substantial historical and cultural value—the battlefield has been described as “a place where ideals and loyalties are put to the test”. Various acts and treaties restrict certain belligerent conduct to an identified battlefield. Other legal regimes promote the preservation of certain battlefields as sites of historic importance.

Modern military theory and doctrine has, with technological advances in warfare, evolved the understanding of a battlefield from one defined by terrain to a more multifaceted perception of all of the factors affecting the conduct of a battle and is conceptualised as the battlespace.
