Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The wait time for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches through an electronic search provider some searches are still processed processed manually by the Local Authority. Also the search time can be affected by seasonal demand levels and Local Authority staffing levels.

Do you recommend that both of us order a Environmental search on the property that we are buying in Beamish? Yes we including this in our quote. We would always recommend an environmental search on the property you intend to purchase which is available from a number of search providers including Argyll Site Solutions. The environmental search results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the properties, based upon the information revealed by the search, would be classified contaminated land by the council.

What is a a CON29 DW search ? A Drainage & Water Enquiry confirms to a prospective buyer that the land parcel they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Beamish which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

Remember there are frequently several linked transactions involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest purchase.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a home buyer makes is not checking the plan properly. It is a good idea to visit the home to check that what is shown on the plan agrees with what you think you’re buying on site. All too often clients mistakenly think that a piece of land at the side or rear of the house is theirs, only to find out that the legal title to the property doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays required to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Beamish some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Beamish

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Beamish.

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain procedures to ensure release of those ISAs including any bonus. If you complete the estimate you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 36 months.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We are administrators of our family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
