Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The time for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through our search provider’s website some searches are still processed handled manually by the council. Also the search ETA can be affected by seasonal demand levels and Local Authority staffing levels.

When we order an Environmental search on the property mentioned on the conveyancing quote for the property in Bean what will it reveal? The search provides data of present and past contamination risks together with a certificate from an environmental consultant confirming whether or not the properties would be officially names as contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Apart from showing that the land in Bean is connected to the mains water supply and mains drainage what other results does a Drainage & Water Enquiry show? A a CON29 DW search confirms to a future buyer that the site they are purchasing does not need a “build over consent” because the previous owner has constructed an addition to the house near a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are often one or more connect sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale or purchase.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time scale in Bean you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bean

Are you able to manage a mortgage with M&S Bank in Bean? Yes we are on the mortgage Panel for this lender.

Are you able to handle Help to Buy ISAs in Bean? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 36 months.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company usually it is approximately £200 but is can be more in extreme cases. Second, the lease usually contains a mechanism for the outgoing to pay a payment to the landlord based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
