Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental enquiries in Beanley? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am told that the local Searches in Beanley will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of locating polluted land parcels and recording these land parcels on registers – this is a process which will take a number of years to finish. Needless to say any ground named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Apart from showing that the home in Beanley is connected to the mains water supply and mains drainage what other replies does a Drainage & Water Enquiry contain? A a CON29 DW search verifies to a future interested party that the land they are purchasing does not need a “build over consent” because the owner has constructed an addition to the house within three metres of a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your house to take possibly 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Beanley you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Beanley

Are you able to deal with a mortgage with The Mortgage Lender Limited in Beanley? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Beanley? Is this a concern? No because like all modern practices we count on technology to assist us in our practice to ensure that matters are dealt with rapidly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Beanley).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Beanley? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is approximately £2500 but is can be more in unusual cases. Second, the lease usually contains a clause for the assignor to pay a charge to the landlord based on a % of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.

About Beanley.

Beanley is a village in Northumberland, in England. It is situated to the north-west of Alnwick, near Eglingham.

In 1870–1872, John Marius Wilson’s Imperial Gazetteer of England and Wales described Beanley as “a township in Eglingham parish, Northumberland; on the river Breamish, 7 miles NW of Alnwick. Acres, 2,341. Pop., 116. Houses, 23. The earls of Dunbar anciently held it on the tenure of maintaining a road into Scotland. A cross stands on Hedgeley-moor, at a short distance from the village, erected to the memory of Sir Ralph Percy, who fell in 1464 in a battle with the Yorkists.”

Beanley is in the parliamentary constituency of Berwick-upon-Tweed.
