Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such purchasers think they know what a local search LLC1 will reveal and may know about the Beccles or surrounding neighbourhood however most solicitors will still prescribe one. One of the main reasons is that the local search LLC1 is the only place to reveal indebtedness to the borough and this is more commonly the case with probate properties.

I believe that the local authority Searches in Beccles will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of identifying polluted property and recording these land on registers – this is a process which will take a decades to finish. Needless to say any land parcels comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Apart from showing that the site in Beccles is connected to the mains water supply and mains drainage what other results does a drainage search include? A a CON29 DW search shows to a future buyer that the land they are interested in does not need a “build over consent” because the previous owner has constructed an extension within three metres of a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are more often than not a few related sales involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest purchase.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays incurred to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Beccles some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain checks to make sure release of those monies including any bonus. If you complete the estimate you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300k. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We are administrators of our fathers estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.
