Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Beckbury. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

Do you recommend that both of us get an Environmental search on the property that we are buying in Beckbury? Yes we including this in our quote. We would always recommend an environmental search on the property you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental check results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the area, based upon the information revealed by the search, could be designated contaminated land by the London Borough/council.

Apart from showing that the property in Beckbury is connected to the mains water supply and mains drainage what other replies does a drainage search contain? A a CON29 DW search confirms to a prospective purchaser that the property they are buying does not need a “build over consent” because the previous owner has constructed an alteration close to a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are always likely to be many linked purchases involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Beckbury some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

Are you able to manage a mortgage with Dudley Building Society in Beckbury? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Help to Buy ISAs in Beckbury? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain checks to ensure release of those savings including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional payments can we anticipate? We cannot give you all the expenses up front in our quote. The costs charged by landlords and managing agents will vary for providing information often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two flats.
