What is included in a local authority search covering Beckenham? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Beckenham what will it reveal? The search provides information of present and past pollution risks together with a report from an environmental consultant confirming whether or not the land is likely to be classified contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon prone area.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Beckenham you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Beckenham

Are you on the panel of Newcastle Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Beckenham.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be more in extreme cases. Second, the lease usually contains a mechanism for the assigning to pay a payment to the landlord based on a % of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.

About Beckenham.

Beckenham () is a town in Greater London, England, within the London Borough of Bromley and the historic county of Kent. It is located 8.4 miles (13.5 km) south-east of Charing Cross, situated north of Elmers End and Eden Park, east of Penge, south of Lower Sydenham and Bellingham, and west of Bromley and Shortlands. Its population at the 2011 census counted 46,844 inhabitants.

Beckenham was, until the coming of the railway in 1857, a small village, with most of its land being rural and private parkland. John Barwell Cator and his family began the leasing and selling of land for the building of villas which led to a rapid increase in population, between 1850 and 1900, from 2,000 to 26,000. Housing and population growth has continued at a lesser pace since 1900.

The town, directly west of Bromley, has areas of commerce and industry, principally around the curved network of streets featuring its high street and is served in transport by three main railway stations — nine within the post town — plus towards its western periphery two Tramlink stations. In common with the rest of Bromley, the largest borough of London by area, Beckenham has several pockets of recreational land which are a mixture of sports grounds, fishing ponds and parks.
