Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not reveal developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Beckton. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

I believe that the Land Charges Search in Beckton will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that councils are now in the process of finding contaminated properties and recording these properties on registers – this is a process which will take a number of years to finish. Needless to say any areas entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Enquiries are likely to be incomplete.

Why is a water authority search vital if you want to extent or alter the home in Beckton? One of the salient details shows information of any public sewer on the home you are interested in. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Beckton you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Beckton

Are you able to deal with a mortgage with Monmouthshire Building Society in Beckton? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Beckton.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our parents estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.

About Beckton.

Beckton is a suburban district in East London, England, within the London Borough of Newham and is located 8 miles (12.9 km) east of Charing Cross. Historically part of Essex, Beckton was unpopulated marshland adjacent to the River Thames until the development of major industrial infrastructure in the 19th century to support the growing metropolis of London. Housing was created in Beckton for workers of the gas and sewage works. Between 1981 and 1995 it was within the London Docklands Development Corporation area, which caused the population to increase as new homes were built and the Docklands Light Railway was constructed.
