How long do local search LLC1 searches take? The ETA for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches electronically some searches are still processed managed manually by the council. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

I am told that the Land Charges Search in Becontree Heath will show if the land is contaminated. Is that right? How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading trading down and have a lot of items to get rid of. You can accelerate the process if it is a first time buy. You may be able to exchange and complete together. However your desire depend on what  others in the chain will agree to.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a customer makes is not checking the plan properly. It is a best to go to the home to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often consumers mistakenly think that a piece of land at the side or rear of the house is theirs,only to discover that the legal title to the home doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills necessary to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Becontree Heath some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is around £2500 but is can be higher in rare cases. Second, the lease usually contains a mechanism for the assignor to pay a payment to the landlord based on a % of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
