Searches on my Conveyancing Quote

What is included in a local authority search covering Bedale? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I believe that the official local Searches in Bedale will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of finding polluted property and recording these areas on registers – this is a process which will take a an uncertain amount of time to complete. Needless to say any areas entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Why is a drainage search essential if you want to extent or alter the land parcel in Bedale? One of the indispensable details shows information of any public sewer nearby the land parcel you are acquiring. This is worth knowing because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

There is invariably a mortgage loan to arrange and it should be noted that a conveyancer cannot rely on a oral confirmation by mortgage broker or anyone else. The Solicitor must generally have sight of your formal written offer of mortgage in order that she may (i) be able to check that you are getting the money you need and be able to check that you can comply with any conditions of the mortgage offer imposed in the mortgage offer.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a client makes is not checking the plan properly. It is a best to visit the land to check that what is shown on the plan agrees with what you think you’re buying on site. All too often buyers mistakenly think that a piece of land at the side or rear of the house is theirs, only to find out that the legal title to the land doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills required to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bedale some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Bedale

Are you on the panel of Bluestone Mortgages? Yes we act for all major lenders and many smaller lenders.

We note that you do not have an office in Bedale? Is this a problem? No because like all modern firms of lawyers we depend on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bedale).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by freeholder and management companies will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is around £2500 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.

About Bedale.

Bedale ( BEE-dayl) is a market town and civil parish in the district of Hambleton, North Yorkshire, England. Historically part of the North Riding of Yorkshire, it is situated 34 miles (55 km) north of Leeds, 26 miles (42 km) south-west of Middlesbrough and 7 miles (11 km) south-west of the county town of Northallerton. It was originally in Richmondshire and listed in the Domesday Book as part of Catterick wapentake, which was also known as Hangshire (so named from Hang Bank in Finghall and because of the many gallows used to execute marauding Scots); it was split again and Bedale remained in East Hang. Bedale Beck is a tributary of the River Swale, which forms one of the Yorkshire Dales, with its predominance of agriculture and its related small traditional trades, although tourism is increasingly important.
