General Conveyancing Tips

There is commonly a mortgage loan to arrange and it should be noted that a conveyancer cannot rely on a quick email by mortgage broker or anyone else. The lawyer should have sight of your final written offer of mortgage in order that she may (i) ensure that you are getting the advance you need and be able to check that you can comply with any lender’s conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays required to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Beddington Corner some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Beddington Corner

Are you on the panel of Virgin Money? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Beddington Corner.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within three years.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the disbursements up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation often it is approximately £300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple maisonettes.

About Beddington Corner.

Beddington is a suburban settlement in the London Borough of Sutton on the boundary with the London Borough of Croydon. Beddington is formed from a village of the same name which until early the 20th century still included land which became termed entirely as Wallington. The BedZED low energy housing estate (or Beddington Zero Energy Development) is, in non-ecclesiastical terms, in the neighbouring locality of Hackbridge. The latter was in the 13th century shown on local maps as Hakebrug, and named after a bridge on the River Wandle. The locality has a landscaped wooded park at Beddington Park – also known as Carew Manor; and a nature reserve and sewage treatment works in the centre and to the north of its area respectively. The population of Beddington according to the 2011 census is 21,044.

Beddington forms part of the Carshalton and Wallington constituency, which is represented in Westminster by Conservative Elliot Colburn. Of the six councillors that Beddington elects to Sutton Council (from the wards Beddington North and Beddington South), three are Liberal Democrats and three are Independents.
