Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local authority covering Begbroke. Usually, you can search most planning applications on the council’s website by postcode or by map search).

When we ask for an Environmental check on the property mentioned on the conveyancing quote for the property in Begbroke what will it reveal? The search provides replies of present and past pollution risks together with a report from an environmental expert confirming whether or not the land would be officially names as contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Why is a drainage search critical if you want to extent or alter the property in Begbroke? One of the critical details shows a map of any public sewer within the property you are interested in. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the extension cost more.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your house to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills needed to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Begbroke some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Begbroke

Are you on the panel of Halifax? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Begbroke? Is this a concern? No because like all modern lawyers we count on technology to assist us in our office to ensure that matters are dealt with quickly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Begbroke).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in Begbroke? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional costs can we anticipate? We cannot give you all the expenses up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is around £200 but is can be higher in rare cases. Second, the lease usually contains a agreement for the assignor to pay a charge to the management company based on a % of the sale price which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
