Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The wait time for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches via a website some searches are still processed handled manually by the Local Authority. Also the search time can be affected by seasonal demand levels and local council staffing levels.

Is there a need environmental searches in Belaugh Village? Statutory laws have resulted in a clear-up scheme for polluted ground. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into insolvency the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an leasehold in Belaugh Village you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Why is a Drainage & Water Enquiry critical if you want to extent or alter the site in Belaugh Village? One of the crucial replies shows a map of any public sewer within the house you are interested in. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the footings more expensive.

General Conveyancing Tips

Remember there are more often than not a few related transactions involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a consumer makes is not checking the plan properly. It is a best to go to the house to check that what is shown on the plan agrees with what you think you’re buying on site. All too often clients mistakenly think that a piece of land at the side or rear of the property is theirs, only to discover that the legal title to the site doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills required to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Belaugh Village some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Belaugh Village

Are you able to oversee a mortgage with Bank of Ireland in Belaugh Village? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Belaugh Village.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing assignment packs often in a form called LPE1. The charge for this varies from company to company often it is around £2500 but is can be more in rare cases. Second, the lease often contains a agreement for the outgoing to pay a charge to the freeholder based on a percentage of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
