Searches on my Conveyancing Quote

What is included in a local authority search covering Belchamp Walter? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that we get a Environmental enquiry on the property that we are buying in Belchamp Walter? Yes we including this in our quote. We would always recommend an environmental check on the site you intend to purchase which is available from a number of suppliers including Homecheck. The environmental search results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the land, based upon the information revealed by the search, could be officially names as contaminated land by the London Borough/council.

Why is a water authority search critical if you want to extent or alter the land in Belchamp Walter? One of the decisive details shows the location of any public sewer nearby the home you are buying. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the footings more costly.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays incurred to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Belchamp Walter some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Belchamp Walter

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Belchamp Walter.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Revenue is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within 36 months.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is around £200 but is can be higher in unusual cases. Second, the lease usually contains a clause for the assignor to pay a charge to the freeholder based on a percentage of the market value which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.
