Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such buyers think they know what a Official Local Authority search will reveal and may know about the Bellingdon or surrounding area however most conveyancing lawyers will still recommend one. One of the main reasons is that the local search LLC1 is the only place to reveal indebtedness to the borough and this is more commonly the case with probate properties.

Why do we need environmental checks in Bellingdon? Statutory rules have resulted in a remediation scheme for contaminated areas. The basic position is that the polluter should fix the problem however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an maisonette in Bellingdon you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Why is a a CON29 DW search key if you want to extent or alter the land parcel in Bellingdon? One of the essential results shows information of any public sewer on the house you are acquiring. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the addition more expensive.

General Conveyancing Tips

Remember there are always likely to be several related transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your matter and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills required to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bellingdon some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Bellingdon

Are you on the panel of Bluestone Mortgages? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Bellingdon? Is this a concern? No because like all modern firms we rely on technology to assist us in our firm to ensure that matters are dealt with expeditiously. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bellingdon).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by landlords and managing agents will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company often it is around £200-300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 flats.
