Searches on my Conveyancing Quote

What is included in a local authority search covering Bellingham? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that I obtain an Environmental search on the property that we are buying in Bellingham? Yes we including this in our quote. We would always recommend an environmental search on the properties you intend to purchase which is available from a number of search providers including Future Climate. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the site, based upon the information revealed by the search, could be classified contaminated land by the Local Authority.

Apart from showing that the land parcel in Bellingham is connected to the mains water supply and mains drainage what other results does a water authority search show? A drainage search verifies to a potential owner that the property they are buying does not need a “build over consent” because the owner has constructed an alteration adjacent a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

We used KER to carry out the conveyancing on the sale of our house. Our conveyancer, Mouzzam, was always available to answer any queries and provided excellent communications through out the process. A great service from Mouzzam from start to finish, always there when needed and replied to my emails straight away. Thanks for all your help. Derek Very helpful.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your home to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time in Bellingham you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bellingham

Are you on the panel of Hinckley & Rugby Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Bellingham? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty . If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within three years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is around £2500 but is can be more in extreme cases. Second, the lease could contains a provision for the assignor to pay a payment to the landlord based on a % of the sale price which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
