Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental enquiries in Belper? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I heard that the Con29 Searches in Belper will show if the land is contaminated. Is that correct? No. Whilst it is correct that councils are now in the process of identifying contaminated sites and recording these sites on registers – this is a process which will take a decades to complete. Needless to say any properties named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Why is a drainage search fundamental if you want to extent or alter the home in Belper? One of the key results shows a plan of of any public sewer within the land parcel you are interested in. This is important because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the addition more expensive.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Couldn’t recommend this company enough, not to expensive and very helpful, but I especially recommend Mouzzam Yamin who dealt with my case of buying my first property. As a first time buyer I was so confused and worried about EVERYTHING …More I am pleased to leave Mouzzam Yamin a 5 star review for his help with the sale of my property.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your property to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your sale and purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the date in Belper you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Belper

Are you on the panel of Dudley Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Belper.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in Belper? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a form called LPE1. The charge for this varies from company to company usually it is approximately £300 but is can be more in rare cases. Second, the lease often contains a mechanism for the assigning to pay a charge to the freeholder based on a % of the market value which is often 2% although other formula may be used. The lease will need to be checked carefully.
