Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not reveal land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Bemerton. Usually, you can search most planning applications planning pages by postcode or by map search).

Do you recommend that I ask for an Environmental check on the property that we are buying in Bemerton? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search companies including Groundsure. The environmental search results provide details of present and past environmental risks together with a statement from an environmental expert confirming whether or not the land, based upon the information revealed by the search, could be designated contaminated land by the council.

What is a drainage search ? A a CON29DW confirms to a potential purchaser that the site they are acquiring is connected to the mains water supply and mains drainage. This is particularly significant in parts of Bemerton which are not built up as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We dealt with Mouzzam who was very quick at replying and managed to complete the property purchase in less than a month. I couldn’t recommend them enough. Great service Excellent service provided by Mouzzam Yamin. Very quick full responses to all contact made. Mouzzam handled everything extremely quickly and diligently on his end, and certainly put the other side’s conveyancer to shame. Would definitely use again in the future and recommend to friends / family if they need the service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is often a mortgage loan to obtain and it should be noted that a solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. The conveyancing lawyer will need to have sight of your final written offer of mortgage in order that they may (i) be able to check that you are getting the advance you need and be sure that you can comply with any conditions of the mortgage offer imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays necessary to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bemerton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Bemerton

Are you able to handle a mortgage with National Counties Building Society and Family Building Society in Bemerton? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Bemerton? Is this a issue? No because like all modern firms of lawyers we depend on technology to assist us in our firm to ensure that matters are dealt with swiftly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bemerton).

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain checks to make sure release of those savings including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We are administrators of my family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.
