How long do local search LLC1 searches take? The time for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through an electronic search provider some searches are still processed handled manually by the council. Also the search ETA can be affected by seasonal demand levels and local council staffing levels.

Do we need environmental investigations in Bengeworth? Statutory laws have resulted in a clear-up scheme for contaminated areas. The basic position is that the polluter should remediate however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an lease in Bengeworth you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Apart from showing that the land in Bengeworth is connected to the mains water supply and mains drainage what other data does a a CON29DW contain? General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading selling down and have a lot of items to get rid of. You can speed the process if it is a first time buy. You may be able to exchange and complete together. However your desire depend on what  others in the chain will comply with.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a purchaser makes is not checking the plan properly. It is a best to visit the land parcel to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the land is theirs, only to discover that the legal title to the land parcel doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays needed to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bengeworth some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bengeworth

Are you able to deal with a mortgage with Coventry Building Society in Bengeworth? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Bengeworth? Is this a problem? No because like all modern lawyers we depend on technology to assist us in our work to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bengeworth).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat what additional disbursements can we anticipate? We cannot give you all the expenses up front in our quote. The costs charged by freeholder and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
