In rare cases the replies can be used to amend your the purchase price or and may even make you pull out of from the buying.

When we obtain a Environmental search on the property mentioned on the conveyancing quote for the property in Benwick what will it reveal? The search provides information of present and past contamination risks together with a report from an environmental expert confirming whether or not the ground might be officially names as contaminated land by the council. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon prone area.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading selling down and have a lot of items to clear. You can prompt the process if it is a first time buy. You may be able to exchange and complete simultaneously. However your instructions depend on what  others in the chain will allow.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a client makes is not checking the plan properly. It is a good idea to visit the property to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often buyers mistakenly think that a piece of land at the side or rear of the home is theirs, only to find out that the legal title to the site doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs incurred to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Benwick some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Benwick

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Benwick.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained Letters of Administration for my family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
