What is included in a local authority search covering Berden? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Remember there are more often than not one or more related purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a client makes is not checking the plan properly. It is a good idea to go to the land to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often customers mistakenly think that a piece of land at the side or rear of the site is theirs,only to discover that the legal title to the land doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time in Berden you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by landlords and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from company to company usually it is around £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into two leaseholds.

About Berden.

Berden is a village and civil parish in Essex, England. Berden village is approximately 6 miles (10 km) north from Bishop’s Stortford, Hertfordshire and 21 miles (34 km) north-west from the county town of Chelmsford. Berden parish, with its own parish council, is in the district of Uttlesford and in the parliamentary constituency of Saffron Walden.

According to the 2001 census Berden had a population of 427, increasing to 465 at the census 2011.

Berden was part of Clavering hundred and is mentioned in the Domesday Book of 1086 as a location with four villagers and five smallholders.

The parish church is dedicated to St Nicholas. Berden Hall dates to the 1580s, although a manor and Berden Priory existed in Berden in medieval times.
