Searches on my Conveyancing Quote

What is included in a local authority search covering Berkswell? There are two parts to a local authority search – Local Land Charges search and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is maintained at public expense, proposals for new roadways, rail schemes or planning permissions relating to the property. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do you recommend that both of us ask for an Environmental enquiry on the property that we are buying in Berkswell? Yes we including this in our quote. We would always recommend an environmental check on the property you intend to purchase which is available from a number of search providers including Groundsure. The environmental check results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the ground, based upon the information revealed by the search, is likely to be classified contaminated land by the local council.

What is a water authority search ? A a CON29DW confirms to a future buyer that the site they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Berkswell which are country as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading trading down and have a lot of items to clear. You can speed the process if it is your first buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will consent to.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a consumer makes is not checking the plan properly. It is a best to visit the land parcel to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often clients mistakenly think that a piece of land at the side or rear of the house is theirs, only to find out that the legal title to the land parcel doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs needed to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Berkswell some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

FAQs in Berkswell

Are you on the panel of Santander? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Berkswell? Is this a issue? No because like all modern firms of lawyers we count on technology to assist us in our office to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Berkswell).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Inland Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We have obtained probate for my mother estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as quoted for this type of Seller.
