Searches on my Conveyancing Quote

What is included in a local authority search covering Berwick St. Leonard? There are two parts to a local authority search – Local Land Charge Register search and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is adopted, proposals for new road schemes, rail schemes or planning history relating to the property. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Is there a need environmental checks in Berwick St. Leonard? Statutory laws have resulted in a clean-up system for contaminated land parcels. The basic position is that the polluter should clear-up however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for remediation costs passes to the present owner (who could be you). Even if you are purchasing an leasehold in Berwick St. Leonard you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Why is a a CON29 DW search vital if you want to extent or alter the home in Berwick St. Leonard? One of the significant results shows a map of any public sewer on the home you are interested in. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the design more costly.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Highly recommended! We have used K.E.R for two purchases now, both which had very complicated and long drawn out issues. They were always approachable, gave excellent advice and managed to get to the bottom of all issues. Their patience and …More i was very happy with the services provided by Mouzzam Yamin in relation to a potential property purchase, especially with his prompt responses and communication, which is so important during a lengthy property purchase process. I would use him again and have recommended him to my friends. Just a note of thanks to Mouzzam for helping us through the conveyacing for our new house. The entire process was completed in barely about 5 weeks!.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your transaction and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time scale in Berwick St. Leonard you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Berwick St. Leonard

Are you able to oversee a mortgage with The Mortgage Lender Limited in Berwick St. Leonard? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Help to Buy ISAs in Berwick St. Leonard? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no SDLT. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a buy to let in Berwick St. Leonard? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained probate for our parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
