Searches on my Conveyancing Quote

What is included in a local authority search covering Bestwood Village? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is adopted, proposals for new road schemes, rail schemes or planning permissions relating to the land. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do we need environmental investigations in Bestwood Village? Statutory laws have resulted in a clean-up scheme for contaminated ground. The basic position is that the polluter should pay however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for remediation costs passes to the existing owner (who could be you). Even if you are purchasing an lease in Bestwood Village you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

Why is a a CON29 DW search key if you want to extent or alter the land parcel in Bestwood Village? One of the vital details shows the location of any public sewer nearby the land parcel you are buying. This is significant because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the foundations more costly.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your property to take possibly 2 to 3 months.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a good idea to visit the house to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land is theirs, only to find out that the legal title to the home doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all bills necessary to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bestwood Village some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Bestwood Village

Are you on the panel of Barclays Bank UK plc? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Bestwood Village.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional payments can we anticipate? We cannot give you all the figures up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be higher in rare cases. Second, the lease could contains a clause for the outgoing to pay a fee to the management company based on a percentage of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.

About Bestwood Village.

Bestwood is an area and civil parish in the Gedling district of Nottinghamshire.
Until 1 April 2018 it was part of the civil parish of Bestwood St. Albans. A small part of the village falls within the Ashfield district council area. There have been several new housing estates built recently including the redevelopment of the former Bayles and Whylie factory site which was a former glue mill.
It is to the east of Hucknall and north of Bulwell. It is neighboured to the north by the village of Papplewick. It is also close to the Bestwood Park Estate which is in the City of Nottingham.

It was once a colliery village but is now considered a more affluent area of the Nottingham conurbation.

Bestwood Mill Lakes are an attractive park in the village, the lakes having been constructed for use by now-defunct water mills.

Bestwood Country Park is an area of heath, grassland, wetland and formal garden which can be accessed from the village. The volunteer group “The Friends of Bestwood Country Park” are involved in improving the park and its wildlife and habitats.

Bestwood Lodge was built in the Gothic style for the 10th Duke of St Albans in 1862–65 by the architect Samuel Sanders Teulon. The current Bestwood Lodge was completed in 1885. Albert Edward, Prince of Wales, often visited incognito to spend a quiet time with his friends, and many old residents remember seeing him walking up from the station by himself. In 1878 he visited with Princess Alexandra for the opening of the Nottingham Castle Museum and both planted a tree at Bestwood. Many signatures were written in the visitor’s book, including Disraeli, Gladstone, and Tennyson.

In the last century, Sir Frank Bowden, head of Raleigh, bought Bestwood Lodge and later it became the headquarters for the Army during World War II. It remained Ministry of Defence property until the mid-1970s when it was converted into The Bestwood Lodge Hotel.

Bestwood Pumping Station, 2 miles north west of the village, was built in 1871-4.

Before the industrial revolution, Bestwood was a small hamlet sustained by agriculture and framework knitting. Bestwood Village was greatly expanded when its coal mine was sunk in 1875 by the Lancaster family. Their Bestwood Coal and Iron Company (BC&IC) also opened an ironworks next to the colliery in 1881 with two blast furnaces and two more were added in 1890. It remained in operation until 1928. The coalmine was one of the most successful mines in the Nottinghamshire coalfield and at its peak employed 2000 men. It closed in 1967. The terraces on Park Road, St. Albans Road and The Square were built by the Bestwood Coal and Iron Company to house its workforce and it is now a conservation area. The company built its offices (with its distinctive clock tower) on Park Road.

The surviving headstock and winding house of Bestwood Colliery in the Nottinghamshire Coalfield, with its vertical steam engine of 1873, has been preserved to commemorate Bestwood’s industrial heritage. It stands at the entrance to the park and is now a listed building. The historic Winding Engine House off Park Road, offers free tours between 10am and 12 noon on Saturdays and Bank Holidays or for groups at other times by special arrangement. The community-run Dynamo House Cafe adjacent to the Winding House is open the same hours.

Bestwood Village has an active Women’s Institute and is home to the Bestwood Male Voice Choir. The Bestwood Welfare Black Diamonds Brass Band has been running since 1947.

Bestwood is part of Nottinghamshire’s Hidden Valleys area. Bestwood Village parkrun began in 2017. It is an all-inclusive 5 km event in Bestwood Country Park: every Saturday morning at 9am, runners, joggers and walkers start from by the Country Park Dynamo House NG6 8UE. The event has been supported financially by Gedling Borough Council, and local firms and individuals. The course is described as “undulating”.
