Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a property and do not necessarily have to conduct a search. Many such home buyers think they know what a Official Local Authority search will reveal and may know about the Betchworth or surrounding vicinity however most conveyancing lawyers will still recommend one. One of the main reasons is that the Local Authority search is the only place to reveal monies due to the Local Authority and this is more commonly the case with .

I believe that the local Searches in Betchworth will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of finding contaminated properties and recording these sites on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any sites listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

Why is a a CON29DW fundamental if you want to extent or alter the land in Betchworth? One of the decisive results shows a map of any public sewer adjacent the site you are purchasing. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the works cost more.

General Conveyancing Tips

Remember there are more often than not many linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time in Betchworth you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Betchworth

Are you on the panel of Tipton & Coseley Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Betchworth? Is this a problem? No because like all modern lawyers we count on technology to assist us in our work to ensure that matters are dealt with promptly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Betchworth).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Taxman is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation mainly it is around £200 but is can be more in rare cases. Second, the lease may contains a mechanism for the outgoing to pay a payment to the freeholder based on a percentage of the market value which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.

About Betchworth.

Betchworth is a village and civil parish in the Mole Valley district of Surrey, England. The village centre is on the north bank of the River Mole and south of the A25 road, almost 3 miles (4.8 km) east of Dorking and 3 miles (4.8 km) west of Reigate. London is 19.5 miles (31.4 km) north of the village.

Service sector occupations dominate Betchworth’s economy – its station and road links make it a part of the London commuter belt – combined with crop agriculture and services for a relatively large retired proportion of the population. A former lime quarry, rebuilt manor house and Grade I-listed church are within its boundaries.
