Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental searches in Bewbush? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I heard that the local Enquiries in Bewbush will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of finding polluted ground and recording these properties on registers – this is a process which will take a many years to accomplish. Needless to say any property included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

Why is a drainage search significant if you want to extent or alter the site in Bewbush? One of the important results shows a plan of of any public sewer within the land you are buying. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the addition cost more.

General Conveyancing Tips

Remember there are always likely to be many related purchases involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs required to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bewbush some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Bewbush

Are you able to conduct a mortgage with Atom Bank in Bewbush? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Bewbush.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Bewbush? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional payments can we anticipate? We cannot give you all the disbursements up front in our estimate. The costs charged by freeholder and management companies will vary for providing assignment packs often in a form called LPE1. The charge for this varies from company to company broadly it is around £200 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 flats.
