Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such consumers think they know what a Enquiries of the local authority search will reveal and may know about the Bewholme or surrounding vicinity however most conveyancers will still recommend one. One of the main reasons is that the Local Authority search is the only place to reveal liabilities to the local council and this is more commonly the case with properties where the owner has gone into a home.

I heard that the Land Charges Search in Bewholme will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of identifying polluted properties and recording these land on registers – this is a process which will take a unknown period of time to complete. Needless to say any land parcels entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

What is a Drainage & Water Enquiry ? A a CON29 DW search confirms to a potential buyer that the land they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Bewholme which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your house to take approximately eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your transaction and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all expenses needed to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bewholme some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Bewholme

Are you able to manage a mortgage with Coventry Building Society in Bewholme? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Bewholme? Is this a problem? No because like all modern law firms we depend on technology to assist us in our practice to ensure that matters are dealt with quickly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bewholme).

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain steps to make sure release of those savings including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
