Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a house and do not necessarily have to conduct a search. Many such purchasers think they know what a Local Authority search will reveal and may know about the Bexwell or surrounding neighbourhood however most solicitors will still recommend one. There is invariably a mortgage to apply for and it should be noted that a conveyancing solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancing solicitor must generally have sight of your formal written mortgage offer in order that they may (i) verify that you are getting the amount you need and be sure that you can comply with any offer conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT.
