Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing a house and do not necessarily have to conduct a search. Many such home buyers think they know what a Local Authority search will reveal and may know about the Bicknacre or surrounding area however most lawyers will still suggest one. One of the main reasons is that the local search LLC1 is the only place to reveal monies due to the Local Authority and this is more commonly the case with probate properties.

I heard that the Land Charges Search in Bicknacre will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of locating contaminated sites and recording these areas on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any properties included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

Why is a a CON29DW essential if you want to extent or alter the house in Bicknacre? One of the significant details shows the location of any public sewer adjacent the home you are buying. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your home to take approximately eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your sale and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all outlays necessary to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bicknacre some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bicknacre

Are you able to manage a mortgage with Virgin Money in Bicknacre? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Bicknacre? Is this a problem? No because like all modern practices we depend on technology to assist us in our firm to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bicknacre).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained Letters of Administration for our family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
