Searches on my Conveyancing Quote

What is included in a local authority search covering Bidford-on-avon? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to whether the roadway abutting the property is public or private, proposals for new road schemes, railway schemes or planning approvals relating to the title. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Why do we need environmental checks in Bidford-on-avon? Statutory rules have resulted in a remediation system for polluted areas. The basic position is that the polluter should clear-up however where that party is missing (for example because the work was done some time ago or the company has gone into insolvency the liability for remediation costs passes to the current owner (who could be you). Even if you are purchasing an lease in Bidford-on-avon you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Why is a a CON29 DW search fundamental if you want to extent or alter the site in Bidford-on-avon? One of the key replies shows a plan of of any public sewer adjacent the land you are acquiring. This is worth knowing because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the foundations more costly.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a best to visit the property to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often customers mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the land parcel doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all expenses necessary to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bidford-on-avon some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Bidford-on-avon

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Bidford-on-avon? Is this a concern? No because like all modern firms of lawyers we rely on technology to assist us in our office to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bidford-on-avon).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 3 years.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I am the administrators of my family estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
