Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not show developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Bighton. Usually, you can search most planning applications on line by postcode or by map search).

I heard that the Land Charges Enquiries in Bighton will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating contaminated land and recording these sites on registers – this is a process which will take a a long time to deliver upon. Needless to say any property listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local Enquiries are likely to be incomplete.

Apart from showing that the home in Bighton is connected to the mains water supply and mains drainage what other data does a a CON29DW contain? A Drainage & Water Enquiry shows to a potential purchaser that the land they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your house to take around eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all expenses required to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bighton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Bighton

Are you able to deal with a mortgage with Lloyds Bank in Bighton? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Bighton.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no SDLT. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional fees can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from company to company mainly it is approximately £200-300 but is can be higher in extreme cases. Second, the lease often contains a mechanism for the assigning to pay a charge to the management company based on a percentage of the market value which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
