Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The wait time for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches electronically some searches are still processed handled manually by the Local Authority. Also the search time can be affected by seasonal demand levels and local council staffing levels.

I am advised that the local Enquiries in Billericay will show if the land is contaminated. Is that right? That is not correct. Whilst it is correct that Local Authorities are now in the process of identifying contaminated land and recording these land on registers – this is a process which will take a a long time to finish. Needless to say any land entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

What is a a CON29 DW search ? A water authority search confirms to a potential purchaser that the property they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Billericay which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your matter and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time period in Billericay you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Billericay

Are you on the panel of The Mortgage Lender Limited? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Billericay? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain checks to facilitate release of those ISAs including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from company to company usually it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
