What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental searches in Billingsgate? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to get rid of. You can prompt the process if it is your first purchase. You may be able to exchange and complete together. However your option depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your sale and purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Billingsgate some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is around £300 but is can be higher in rare cases. Second, the lease usually contains a provision for the outgoing to pay a payment to the freeholder based on a % of the sale price which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
