Searches on my Conveyancing Quote

What is included in a local authority search covering Billington? There are two parts to a local authority search – LLC1 and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is adopted, proposals for new roadways, rail schemes or planning approvals relating to the title. The search can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I believe that the official local Searches in Billington will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of locating contaminated land and recording these land on registers – this is a process which will take a an uncertain amount of time to accomplish. Needless to say any land parcels entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a drainage search ? A Drainage & Water Enquiry confirms to a prospective purchaser that the land they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of Billington which are countryside as there may be a a private drainage system.

General Conveyancing Tips

Remember there are always likely to be one or more connect purchases involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale or purchase.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time in Billington you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Billington

Are you on the panel of Buckinghamshire Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Billington.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained Letters of Administration for my parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
