Searches on my Conveyancing Quote

What is included in a local authority search covering Binley? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Is there a need environmental investigations in Binley? Statutory laws have resulted in a clear-up system for polluted sites. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into insolvency the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an maisonette in Binley you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Why is a a CON29 DW search critical if you want to extent or alter the land parcel in Binley? One of the fundamental replies shows information of any public sewer within the site you are acquiring. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the extension more costly.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

I can honestly say that Mark Sadler is the best property solicitor I have ever experienced and I have dealt with many over the years. I found him on google after 2 days of searching for the answer to a very complicated freehold/leasehold problem. When I called him about our dilemma, Mark knew exactly how to tackle it and he did so with great ease. He dealt with every communication promptly, courteously and efficiently. I could not have asked for more and I am extremely grateful to him for taking on our case. I would not hesitate to recommend him to anyone with a property related legal issue. Thank you again.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your home to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your sale and purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Binley you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Binley

Are you on the panel of TSB Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Binley.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain steps to make sure release of those ISAs including any bonus. If you complete the quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300k. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Binley? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are executors of my parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.
