Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a property and do not necessarily have to conduct a search. Many such consumers think they know what a Local Authority search will reveal and may know about the Binton or surrounding area however most conveyancing solicitors will still advise one. One of the main reasons is that the Local Authority search is the only place to reveal debts to the borough and this is more commonly the case with .

Do you recommend that we order an Environmental check on the property that we are buying in Binton? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of suppliers including Future Climate. The environmental enquiry results provide details of present and past environmental risks together with a statement from an environmental expert confirming whether or not the ground, based upon the information revealed by the search, is likely to be officially names as contaminated land by the local council.

What is a water authority search ? A a CON29 DW search confirms to a future owner that the house they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Binton which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

Remember there are commonly many related purchases involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Binton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Binton

Are you on the panel of Paragon? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Binton? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We are executors of my mother estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
