Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental checks in Birch? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am advised that the local Searches in Birch will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that councils are now in the process of finding polluted sites and recording these areas on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any sites named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

Apart from showing that the property in Birch is connected to the mains water supply and mains drainage what other results does a a CON29DW show? A water authority search verifies to a potential owner that the land they are buying does not need a “build over consent” because the seller has constructed an addition to the house close to a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We dealt with Mouzzam who was very quick at replying and managed to complete the property purchase in less than a month. I couldn’t recommend them enough. Great service Excellent service provided by Mouzzam Yamin. Very quick full responses to all contact made. Mouzzam handled everything extremely quickly and diligently on his end, and certainly put the other side’s conveyancer to shame. Would definitely use again in the future and recommend to friends / family if they need the service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is frequently a mortgage to apply for and it should be noted that a conveyancer cannot rely on a quick email by mortgage broker or anyone else. We will need to have sight of your final written offer of mortgage in order that he may (i) be able to check that you are getting the loan you need and verify that you can comply with any offer conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your purchase and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time period in Birch you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Birch

Are you on the panel of Melton Mowbray Building Society? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Birch? Is this a problem? No because like all modern firms we rely on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Birch).

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Birch? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from company to company usually it is approximately £2500 but is can be more in unusual cases. Second, the lease may contains a mechanism for the selling to pay a fee to the landlord based on a percentage of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
