Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental searches in Birch Vale? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Birch Vale what will it reveal? The search provides replies of present and past pollution risks together with a assessment from an environmental expert confirming whether or not the property could be designated contaminated land by the local council. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Why is a a CON29 DW search indispensable if you want to extent or alter the site in Birch Vale? One of the key results shows a map of any public sewer close to the land you are purchasing. This is significant because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the design more expensive.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We had a lengthy process with our lender in relation to a re-mortgage which was a bit tedious but Mouazzam Yamin helped us to get to the end of what could have been a painful process. Grateful for the help and eventually completing which was a great moment for me! Excellent and proffesional conveyancing service received for the purchase of my property. Mouzzam Yamin and Mark Sadler were both very helpful and informative with replies to my queries. Easy to deal with and hassle free.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time period in Birch Vale you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Birch Vale

Are you able to conduct a mortgage with M&S Bank in Birch Vale? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Birch Vale? Is this a concern? No because like all modern solicitors we rely on technology to assist us in our work to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Birch Vale).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I am the executor of our parents estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.

About Birch Vale.

Birch Vale is a village in the High Peak district of Derbyshire, just outside the boundary of the Peak District National Park, between New Mills and Hayfield. Most of Birch Vale, including the attached hamlet of Thornsett, comes under the administration of New Mills Town Council, though the small part to the east of the former Grouse public house is within the boundaries of Hayfield.

There are no shops, but two surviving public houses: the Sycamore Inn and Printers Arms in Thornsett (the Vine Tavern has closed permanently, the Waltzing Weasel became a B&B in 2013 and the Grouse Inn closed in January 2020). There is a primary school in Thornsett. Until 1970, Birch Vale had a railway station on the branch line from New Mills Central to Hayfield with through trains to Manchester Piccadilly. Today the trackbed of the former railway line carries the Sett Valley Trail, and the nearest railheads are the stations in New Mills — Central and Newtown — about two miles away. There are frequent bus services into New Mills, Hayfield, Glossop, Buxton and Stockport.

Birch Vale’s most famous daughter is the TV presenter Tess Daly who grew up there.

In the early evening of Friday 2 October 2009 a large explosion was heard by residents as the Stirling Lloyd factory on a local industrial estate caught fire. It took around 16–20 hours to bring the fire under control. Local residents were evacuated shortly after police arrived. New Mills Fire and Rescue Team were among the first on the scene.
