Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The time for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches via a website some searches are still processed managed manually by the local council. Also the search wait time can be affected by seasonal demand levels and Local Authority staffing levels.

I believe that the Con29 Enquiries in Birchington-on-Sea will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of identifying contaminated areas and recording these areas on registers – this is a process which will take a decades to end. Needless to say any ground listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Enquiries are likely to be incomplete.

Why is a drainage search important if you want to extent or alter the land parcel in Birchington-on-Sea? One of the most useful results shows the location of any public sewer adjacent the house you are buying. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the works more costly.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your property to take about 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a quote what disbursements apply to your sale and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all expenses needed to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Birchington-on-Sea some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Birchington-on-Sea

Are you able to conduct a mortgage with Barclays Bank UK plc in Birchington-on-Sea? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Birchington-on-Sea.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to facilitate release of those ISAs including any bonus. If you complete the online quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by landlords and management companies will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from company to company usually it is approximately £300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.

About Birchington-on-Sea.

Birchington-on-Sea is a village in northeast Kent, England, with a population of around 10,000.

It is part of the Thanet district and forms part of the civil parish of Birchington. It lies on the coast facing the North Sea, east of the Thames Estuary, between the seaside resorts of Herne Bay and Margate. As a seaside resort, the village is a tourist and retirement destination. The village’s Minnis Bay is a family beach with attractions such as sailing, windsurfing, a paddling pool and coastal walking routes. Its three smaller beaches are surrounded by chalk cliffs, cliff stacks and caves.

The village was first recorded in 1240. Its parish church, All Saints’, dates to the 13th century and its churchyard is the burial place of the 19th-century Pre-Raphaelite artist Dante Gabriel Rossetti. Quex Park, a local 19th century manor house, is home to the Powell-Cotton Museum and a twelve-bell tower built for change ringing.

The museum contains a large collection of stuffed exotic animals collected by Major Percy Powell-Cotton on his travels in Africa, and also houses artefacts unearthed in and around Birchington by his daughter, Antoinette Powell-Cotton, a keen archaeologist.
