Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a property and do not necessarily have to conduct a search. Many such purchasers think they know what a Enquiries of the local authority search will reveal and may know about the Birdingbury or surrounding locale however most solicitors will still advise one. One of the main reasons is that the local search LLC1 is the only place to reveal debts to the Local Authority and this is more commonly the case with .

I heard that the Con29 Enquiries in Birdingbury will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of finding contaminated ground and recording these land parcels on registers – this is a process which will take a a long time to deliver upon. Needless to say any land parcels named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Enquiries are likely to be incomplete.

Why is a a CON29DW significant if you want to extent or alter the property in Birdingbury? One of the important results shows the location of any public sewer nearby the home you are interested in. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the footings more expensive.

Completed on our first home April 2016 and these guys were brilliant. Freddie Rylah guided us through the process step by step and was always available to answer any questions and help us out. As first time buyers we were reassured at every turn and the whole thing was quick and successful! Would highly recommend.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your property to take possibly eight and twelve weeks.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a buyer makes is not checking the plan properly. It is a good idea to go to the land parcel to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often clients mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to find out that the legal title to the site doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time in Birdingbury you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Birdingbury

Are you on the panel of Bluestone Mortgages? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Birdingbury.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no SDLT. If you are paying between £300,000 and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional disbursements can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £2500 but is can be more in unusual cases. Second, the lease may contains a agreement for the selling to pay a charge to the management company based on a percentage of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.
