Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental searches in Birds Green? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am told that the local Searches in Birds Green will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of identifying polluted land parcels and recording these properties on registers – this is a process which will take a decades to accomplish. Needless to say any sites included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Why is a Drainage & Water Enquiry vital if you want to extent or alter the house in Birds Green? One of the basic replies shows a plan of of any public sewer adjacent the home you are acquiring. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the addition cost more.

General Conveyancing Tips

Remember there are always likely to be one or more related transactions involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your transaction and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on fees disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time in Birds Green you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Birds Green

Are you able to manage a mortgage with Newcastle Building Society in Birds Green? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Birds Green.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within 3 years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the administrators of my fathers estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our costs remain the same as quoted for this type of Seller.
