What is included in a local authority search covering Birmingham? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new major roads, rail schemes or building consents relating to the land. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I think that the Con29 Enquiries in Birmingham will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that Local Authorities are now in the process of finding polluted areas and recording these sites on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any areas listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

Why is a drainage search useful if you want to extent or alter the site in Birmingham? One of the important details shows a map of any public sewer on the site you are buying. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the design more costly.

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to get rid of. You can speed the process if it is a first time buy. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all outlays required to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Birmingham some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main residence within three years.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the expenses up front in our quote. The costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is approximately £300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into two maisonettes.
