Searches on my Conveyancing Quote

What is included in a local authority search covering Bishampton? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to whether the roadway abutting the property is adopted, proposals for new major roads, railway schemes or planning history relating to the title. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do you recommend that I obtain an Environmental enquiry on the property that we are buying in Bishampton? Yes we including this in our quote. We would always recommend an environmental check on the land parcel you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental check results provide details of present and past environmental risks together with a certificate from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, is likely to be classified contaminated land by the Local Authority.

Why is a a CON29 DW search indispensable if you want to extent or alter the land in Bishampton? One of the fundamental details shows the location of any public sewer adjacent the property you are acquiring. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the foundations cost more.

General Conveyancing Tips

Remember there are more often than not one or more connect sales involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a buyer makes is not checking the plan properly. It is a good idea to visit the land parcel to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often buyers mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the house doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills needed to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bishampton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bishampton

Are you able to manage a mortgage with Cambridge Building Society in Bishampton? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Help to Buy ISAs in Bishampton? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I am the executor of my family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.
